TERMS AND CONDITIONS FOR THE FAMVILLE WEBSITE

1. WHO WE ARE AND SCOPE OF THESE TERMS
This website, www.famville.net (the "Site"), is operated by:

These Terms and Conditions ("Terms") govern (a) your general use of the Site, and (b) the purchase of event tickets or participation rights ("Tickets") through the Site. They apply in addition to, and take precedence over, our general App Terms of Use where the two conflict on matters specific to website ticket purchases. Our Privacy Policy and Impressum are incorporated by reference.
By using the Site or purchasing a Ticket, you agree to these Terms. If you do not agree, please do not use the Site or complete a purchase.
2. DEFINITIONS

"Event Host" / "Seller" — the third party (e.g., an organizer, school, or partner) who creates and is responsible for delivering an event listed on the Site.

"Buyer" / "you" — the person purchasing a Ticket through the Site.

"Famville," "we," "us" — Famville UG.

"Services" — the Site's functionality, including browsing events, account features, and the ticket checkout flow.
3. OUR ROLE: MARKETPLACE PLATFORM ONLY — WE ARE NOT PART OF THE PAYMENT
Famville provides the technical platform that lets Event Hosts list events and sell Tickets to Buyers. Famville is not a party to, and does not process, hold, or collect, any payment made for a Ticket.

The contract for attending or participating in an event — and the payment for it — is concluded and settled exclusively and directly between you (the Buyer) and the Event Host, using the Event Host's own payment processing arrangement (the Host's own Stripe account). Famville never receives, holds, or has access to Ticket payment funds.

Famville does not organize, operate, or guarantee the performance of any event.

Famville is not responsible for an event's safety, legality, quality, content, or whether it takes place as described, except to the extent stated in Section 14 (Liability) below.

Famville is not a party to, and does not guarantee, the contract between the Buyer and the Event Host.

Where Famville itself is the Event Host for a Famville-organized event (e.g., a Famville Family Games event), Famville acts as both platform and organizer — and, for that event only, as the party actually collecting payment — and Sections 3, 9, 10 do not limit Famville's own responsibility as organizer/seller for that specific event.
4. ELIGIBILITY AND ACCOUNTS
You must be at least 18 years old, or have the consent of a parent/legal guardian, to purchase a Ticket. You are responsible for the accuracy of the information (name, email, payment details) you provide during checkout, and for keeping any associated account credentials confidential.
5. HOW A TICKET ORDER IS PLACED (CONTRACT FORMATION)

Available events and Tickets are displayed on the Site. This display is an invitation to order, not a binding offer from Famville or the Event Host.

By completing checkout and clicking the final "Buy" / "Pay now" button, you submit a binding offer to purchase the selected Ticket(s).

The contract is concluded when we (on behalf of the Event Host) send you an order confirmation by email, or, where earlier, when payment is successfully processed and the e-ticket is issued.

You will be able to review and correct your order (quantity, event, contact details) before submitting it at checkout.

We store the text of the contract (order/payment details) and will make a copy available to you by email; these Terms remain accessible on the Site at all times.
6. PRICES AND PAYMENT

Prices are displayed at checkout in the applicable currency and include statutory VAT where applicable, unless stated otherwise.

Payment is made directly to the Event Host, via the Host's own Stripe account. Famville does not process, receive, or store your payment or full card details at any point.

The Event Host is the merchant of record for the transaction and is responsible for issuing any payment receipt or invoice required by law.

Payment is due immediately upon placing the order unless the Event Host's listing states otherwise.

Where the Event Host uses Stripe for payment processing, this is provided by Stripe Payments Europe, Ltd., 1 Grand Canal Street Lower, Grand Canal Dock, Dublin, Ireland ("Stripe"). Stripe's own terms and privacy practices apply to the payment itself.
7. TICKET DELIVERY
Tickets are provided electronically (e-ticket / QR code) via one or more of the following, depending on how you purchase: made available in the Famville app, sent to the email address you provide, and/or available for direct download immediately after completing a web purchase. Delivery is typically immediate upon payment confirmation, unless the specific event listing states a different method or timing.
8. RIGHT OF WITHDRAWAL (WIDERRUFSRECHT)
If you are a consumer resident in the EU, you generally have a 14-day right to withdraw from an online purchase without giving reasons.
However, this right does not apply to Tickets for events tied to a specific date or period (e.g., concerts, workshops, Family Games events), pursuant to § 312g Abs. 2 Nr. 9 BGB, which exempts contracts for the "provision of accommodation... transport of goods, car rental services, delivery of food or beverages, or services related to leisure activities" where the contract provides for a specific date or period of performance.
This means: once you complete a Ticket purchase for an event with a fixed date, you generally cannot cancel simply because you changed your mind. Any cancellation or refund is instead governed by:

the specific Event Host's cancellation/refund policy shown on the event listing (if provided), and
-
Section 9 below (what happens if the event itself is cancelled, postponed, or materially changed).
9. REFUNDS, EVENT CHANGES, AND CANCELLATIONS

Refunds for Tickets follow the Event Host's own cancellation and refund policy, as displayed on the event listing (if displayed), and applicable law.

Refunds are issued directly by the Event Host, using the same payment channel through which the Buyer paid. Because Famville never receives or holds Ticket payments, Famville is not able to issue refunds on the Host's behalf and is not a party to any refund claim.

If an event is cancelled or materially changed (e.g., date, location, or core content changes significantly) by the Event Host, the Buyer's refund or compensation claim lies against the Event Host directly. Famville will support Buyers by facilitating contact with the Event Host via the app but does not guarantee or process the refund itself.

If Famville becomes aware that an Event Host is failing to honour a required refund, Famville reserves the right to suspend that Host's ability to list further events on the Site.
10. ABOUT THE EVENT HOST (FOR YOUR INFORMATION)
Event Hosts do not use this website directly — they create and manage their events, and agree to their obligations toward Famville, inside the Famville app. This section explains, for your awareness as a Buyer, what governs the Event Host you are buying from:

Event Hosts are required to be authorized to organize their event and sell Tickets for it, and to only list genuine events that will be delivered as described (no fictitious or non-existent events).

The Event Host is solely responsible for the event's legal compliance, safety, permits, and delivery.

The Event Host is the merchant of record: they hold and operate their own Stripe account and collect payment directly from you.

The Event Host is solely responsible for issuing refunds directly to you, in accordance with their own refund policy and applicable law.

If the Event Host cancels an event, or changes its date or location, after Tickets have already been purchased, they are required to refund affected Buyers in full for those Tickets, processed via Stripe to the Buyer's original payment method.
The full set of obligations Event Hosts agree to toward Famville (including commission terms) is set out in the Famville App Terms of Use, which Hosts accept when creating events in the app.
11. EVENT RULES, TICKET HANDLING, AND LISTING ACCURACY

Event-specific Host terms apply too. In addition to these Terms, the Event Host may set its own additional or different terms, house rules, or conditions of entry for its specific event (e.g., age restrictions, dress code, security checks). Famville has no influence over, and is not responsible for, the Event Host's own terms or rules — it is the Buyer's responsibility to check them before attending. Where the Host's terms conflict with these Terms on a matter specific to that event, the Host's terms govern that event.

A Ticket does not itself guarantee entry. The Event Host or venue retains the right to refuse entry for reasons independent of ticket ownership (e.g., safety, capacity, house rules, venue security decisions).

Bulk orders and resale prevention. Famville and/or the Event Host may limit the number of Tickets a single Buyer can purchase for an event, and may decline or cancel orders that appear intended for commercial resale or scalping rather than personal use.

Ticket transfer and resale. If a Ticket is personalized, any transfer or resale by the Buyer to a third party happens without Famville's involvement, and Famville is not responsible for verifying or facilitating such transfers.

Event listing accuracy. Famville and Event Hosts make reasonable efforts to keep event listings (date, time, location, price, description) accurate and current, but details may change on short notice. Famville does not guarantee the accuracy of listing details provided by Event Hosts and is not liable for such changes, except to the extent the change entitles the Buyer to a refund under Section 9 above.
12. USE OF THE WEBSITE (GENERAL)

Eligibility & account accuracy: as above (Section 4).

Permitted use: a limited, non-exclusive, non-commercial licence to browse the Site and complete purchases. No scraping, data-mining, resale, or commercial reuse of listings, prices, or content without our prior written permission.

Prohibited conduct: you agree not to interfere with the Site's operation, circumvent security features, upload harmful code, impersonate others, or use the Site for any unlawful purpose.
13. INTELLECTUAL PROPERTY
All Site content (text, graphics, logos, event listings we created, software) is owned by Famville UG or its licensors and protected by copyright and trademark law. You may not copy, republish, or create derivative works from it without our prior written permission. Event-specific content (photos, descriptions) may be owned by the respective Event Host.
14. DISCLAIMER, LIABILITY, AND EVENT RESPONSIBILITY

The Site is provided "as is." We do not warrant that it will be uninterrupted or error-free.

Famville is not liable for the organization, safety, legality, or delivery of events listed by Event Hosts, nor for payment or refund disputes between Buyers and Event Hosts. Event Hosts are solely responsible for their events and for handling payments and refunds directly with Buyers. Famville's role is limited to providing the listing platform.

Nothing in these Terms excludes or limits liability for intent, gross negligence, injury to life, body, or health, or any other liability that cannot be excluded under German law (§§ 276, 309 BGB).

Beyond that, our liability for ordinary negligence is limited to foreseeable, contract-typical damages arising from breach of a material contractual obligation (Kardinalpflicht).
15. DATA PROTECTION
See our Privacy Policy for how we handle personal data collected during account registration and checkout. Note that payment data itself is provided directly by you to the Event Host's Stripe account and is not shared with or processed by Famville.
16. DISPUTE RESOLUTION
We are not willing to participate in dispute resolution proceedings before a German consumer arbitration board (Verbraucherschlichtungsstelle) within the meaning of § 36 VSBG.
17. GOVERNING LAW AND JURISDICTION
These Terms are governed by German law, excluding the UN Convention on Contracts for the International Sale of Goods (CISG). If you are a consumer habitually resident in the EU, you additionally retain the protections of the mandatory consumer-protection law of your country of residence. For disputes with consumers, the courts of Düsseldorf have non-exclusive jurisdiction, without prejudice to your right to bring proceedings in your own country of residence.
18. CHANGES TO THESE TERMS
We may update these Terms from time to time. Material changes will be posted on the Site with an updated "Effective Date" and, where required by law, notified to you directly for orders already placed.
